Medico-legal brief four: A structured settlements system

One of the recommendations outlined in the South African Law Reform Commission (SALRC) discussion paper[1] was the establishment of structured settlements as a norm for the settlement of medico-legal claims. ASSA has therefore commissioned this policy paper to consider structured settlements as a policy lever to reform medico-legal claim pay-outs. A structured settlement system is discussed in detail along with the advantages of and disadvantages of such a system.
